User Agreement

Rules for using MalishOK, the account, local data and encrypted backups.

This English translation is provided for convenience. If there is any discrepancy, the Russian version published at /terms prevails.

1. General provisions

This User Agreement governs use of the MalishOK website and mobile application. Service owner: Individual Entrepreneur Yulia Tsaplina.

The User accepts this Agreement by checking the relevant box when creating an account. Consent to personal-data processing is given by a separate checkbox and is not included in acceptance of this Agreement.

If the User does not agree, they must not create an account or continue using the service.

2. Service description

MalishOK helps parents and legal representatives keep a child-care and development diary, including:

  • Sleep, feeding, diaper and daily-event trackers.
  • Height, weight, development and achievements.
  • Vaccinations, doctor visits, medicines and notes.
  • Calendar, reminders, export and future PRO features.
  • Local storage and encrypted cloud backup.

3. Account required

An account is required to use the application. Sign-in may be available through email/password, Google or Apple.

The User is responsible for the security of the password, device, recovery key and access to the selected OAuth provider.

An account is created by an adult with legal capacity. By entering information about a child, the User confirms that they are a parent, legal representative or otherwise authorised person.

4. Local data and encrypted backup

Child records are stored locally on the User’s device by default and are not sent to the server as separate fields.

If cloud backup is enabled, it is encrypted on the device before transmission. The server links only the account identifier, ciphertext and technical encryption parameters to the account.

The Operator does not receive the readable decryption key and cannot read or search the backup.

If the User loses the password, recovery key and access to the old device at the same time, MalishOK may be unable to restore the encrypted backup.

5. Service conditions

Features may be added, changed or temporarily unavailable as the service is developed and maintained.

6. Use rules and rights to materials

MalishOK grants the User a simple, non-exclusive right to use the application for personal, non-commercial purposes within its functionality.

The User keeps rights to records and photos they provide. The User is responsible for the lawfulness of those materials and for having the necessary rights to them.

  • Do not attempt to access another person’s account, bypass security or disrupt the service.
  • Do not use the application to unlawfully distribute another person’s personal data or materials.
  • MalishOK names, interface, texts and code must not be copied or distributed beyond what the law permits.

7. Medical information

IMPORTANT: the application is not a medical device and does not replace a doctor’s advice.

  • Do not use the application to diagnose or treat disease.
  • Contact a doctor with any question about a child’s health.
  • Reminders, calendars and records are auxiliary tools.
  • The User is responsible for decisions made on the basis of their records.

8. Limitation of liability

MalishOK is provided as is. The Operator takes reasonable measures to keep the service stable and secure but cannot guarantee the complete absence of technical failures.

Nothing in this section limits rights of the User or liability of the Operator that are directly established by applicable law.

  • The Operator cannot restore ciphertext when the User has simultaneously lost all secrets and devices required for decryption.
  • Some features may depend on Apple, Google, hosting providers and AppMetrica outside the Operator’s technical control.
  • The application does not make medical decisions for the User and does not replace professional care.

9. Changes and termination

For material changes to the Agreement, the User will be notified where reasonably possible no later than 14 days before the changes take effect.

If the User does not agree, they may stop using the application, export available local data and delete the account.

The Operator may temporarily restrict access in case of attempted hacking, unlawful conduct or a material breach of these rules. The User will be informed of the reason where possible.
